A new amendment in Latent Defects not involving personal injury in the Limitation (Amendment) Act 2018 was passed and gazetted. The new Section 6A has come into force on the 1st of September, 2019.
Section 6A(2) of Limitation (Amendment) Act 2018 has been introduced to enable a person to take action founded on damages for negligence not involving personal injuries, where the starting date for calculating the period of limitation under subsection (2) falls after the date on which the cause of action accrued. An action to which this section applied shall not be brought after the expiration of three (3) years from the starting date if the period of three (3) years expires later than the period of limitation prescribed in subsection 6(1). Notwithstanding subsection (2), no action shall be brought after the expiration of fifteen (15) years from the date on which the cause of action accrued
